Less than a month after arrest, Linton man agrees to plead guilty to intimidation
A Linton man who caused a ruckus in a Linton neighborhood in late June, accused of kicking an officer and threatening to kill three officers, has already decided to plead guilty.
A negotiated plea agreement was filed this week in the case of Andrew Charles Damron, 24, signed on Monday by Damron and his attorney, Deputy Public Defender Ellen Martin, and Chief Deputy Prosecutor Keven McIntosh.
Damron was charged with four felonies and two misdemeanor counts including:
- Three counts of intimidation involving a threat to certain types of people, all are Level 6 felonies,
- Battery against a public safety official, a Level 6 felony,
- Two counts of resisting law enforcement, both are Class A misdemeanors, and
- Battery resulting in bodily injury, a Class A misdemeanor.
The charges resulted from an incident that began late Wednesday night, June 27, then continued early Thursday, June 28, investigated by Officer John Agan of the Linton Police Department.
Damron was arrested early Thursday, June 28, and booked into the Greene County Jail where his bond was set at $27,500 with ten percent allowed. Damron did not post bond and has remained in jail since his arrest.
Damron now intends to plead guilty to one count of intimidation, a Level 6 felony, and to battery resulting in bodily injury, a Class A misdemeanor.
If this agreement is accepted by the court, then Damron will be sentenced on both counts and the sentences will be served consecutively or one after the other.
On the count of intimidation, he’ll be sentenced to two years in the Greene County Jail with all but 180 days suspended, he’ll get credit for time already served and he’ll be able to serve his time on work release if he’s eligible.
He’ll also have to serve five days on road crew with Greene County Community Corrections.
Then he be on probation for a one year and six months.
On the count of battery, he’ll be sentenced to 60 days in the Greene County Jail which he can serve on work release if he’s eligible.
Under the terms of the agreement, the other counts will be dismissed.
Greene County Community Corrections will now evaluate Damron for alternative sentencing then submit a report to the court before Damron is sentenced on August 16.
