Intoxicated man found lying on the side of a road

After a caller reported a man lying beside a roadway in Linton and officers responded, the man was taken to the hospital for medical attention but he’s also facing a charge of public intoxication.

David Ray Foster, 42, Linton, is facing a preliminary charge of public intoxication, a Class B misdemeanor.

On Wednesday, April 28, the Linton Police Department got a call from a driver about a man lying next to the road in the area of County Road 150 North and 5th Street NW.

LPD Officer Bobby Pierce said when he arrived in the area, along with Officers Janzen Franklin and Nick Yingling, and Linton Rescue, they found a man, later identified as Foster, wearing a brown Carhart jacket, blue jeans and brown boots, on the ground next to the road. His feet were sticking out into the roadway.

The officers were unsuccessful at rousing Foster at first but he was mumbling and breathing heavily. After several attempts, he got up but was unsteady on his feet, showed signs of intoxication and smelled strongly of an alcoholic beverage. He thought he was in Linton but wasn’t sure where he was.

After Foster almost fell over, he was asked to sit down for safety. Field sobriety testing was not conducted. Officer Pierce reported Foster tested at .131 on a portable breathalyzer.

Foster was transported to Greene County General Hospital for medical attention. A criminal case was filed against him earlier today.
