Brothers arrested, accused of assaulting a man in a parking lot fight in Linton
/Two Linton brothers are accused of an assault on another man in the parking lot of a gas station in Linton. They both told one story about the incident but it was caught on video and the investigating officer reported the video told a different story. The brothers were arrested and are facing criminal charges.
Dalton James Robertson, 22, and Devin James Robertson, 19, both from Linton, were arrested by Officer Wayman JR Blazier of the Linton Police Department on Monday, January 10.
Both were booked into the Greene County Jail around 6:30 p.m. Dalton’s bond was set at $5,500 surety with ten percent cash allowed. He posted $550 and was released the next day. Devin’s bond was set at $1,500 surety with ten percent cash allowed. He posted $150 and was also released the next day.
Criminal cases were filed against both Robertsons yesterday, Thursday, January 20.
Dalton is facing charges of:
Battery resulting in bodily injury, a Class A misdemeanor, and
Strangulation, a Level 6 felony.
Devin is facing a charge of: Battery resulting in bodily injury, a Class A misdemeanor.
The fight occurred around 5:30 p.m. on Sunday, January 9. Officer Blazier was dispatched when LPD Dispatch got a call from an employee at the Chuckles convenience store and gas station in Linton who said three men were fighting in the parking lot. All three left the area while Officer Blazier was on the way but he continued on to Chuckles to speak to the employee and request a copy of any video from the store’s surveillance system that captured the incident.
Then a man contacted LPD and said he was assaulted while at the station and Officer Blazier went to his home to talk to him. The man said Dalton Robertson was the ex-boyfriend of the man’s girlfriend and that Dalton and his brother Devin had confronted him at the station. He said Dalton was angry and wanted to fight, then grabbed him and put him in a chokehold. He fell to the ground during the struggle then tried to defend himself against Dalton but then Devin punched him in the eye and started hitting him.
Officer Blazier noted the man had a black eye, a bruise on a bicep, a scratch on a shoulder, an abrasion on a knee and a bloody hand.
Later when Officer Blazier interviewed Dalton at the police station, he allegedly admitted he went to the station to confront the man over an incident that had occurred a while back involving his ex-girlfriend and their child. He said a verbal altercation turned into a physical altercation and when the man moved, Dalton hit him up the side of the head. He denied putting the man in a headlock or choke hold and said they were hitting each other. Dalton alleged the man lunged at him first and he only hit him in self-defense.
Still later, actually the next day, when Officer Blazier was able to interview Devin, Devin also alleged that the man had lunged at Dalton so Dalton hit him. He also said the man hit Dalton as Dalton was trying to walk away. Devin allegedly said he stayed out of the fight until the man swung at him but missed and then they both hit each other. He denied kicking or hitting the man while the man was on the ground.
But the video from the store’s surveillance system told a different story. Officer Blazier reported that when he was able to view the video, it showed when the man arrived and walked into the store, then the Robertsons pulled in and parked behind the man’s vehicle, got out and also walked into the store. The man paid for his items and walked out. The Robertsons followed him out without purchasing anything.
The video allegedly shows a verbal altercation began when the three were standing next to the man’s car. A few moments later, without any provocation from the man, Dalton punched the man with a closed fist on his face and when the man tried to fight back, Dalton put him in a headlock and choke hold applying pressure to the man’s throat. The man was then pulled to the ground. Once the man was able to get away, he did swing at Dalton and hit him on the side of his face, then faced Devin, who was in a fighting stance, and attempted to hit Devin. When the man and Devin got into a physical fight, the man lost his balance and fell to the ground and while he’s on his hands and knees, the video allegedly shows Devin kicking the man in the face. All of them then got into their vehicles and left the area.
After the last interview with both Dalton and Devin at the police station, both Robertsons were arrested and transported to jail.
Both Robertsons are scheduled to appear in Greene Superior Court on January 24 for their initial hearings.
