Accused man facing Level 1 felony and possible enhanced sentence as habitual offender

A man accused of child molesting was arrested Sunday by a GCSD detective after he interviewed a child at a hospital. His bond has been set at $40,000.

Jimmy Lee England, 44, of Lyons, was arrested by Det. Shawn Cullison of the Greene County Sheriff’s Department on Sunday, October 27.

Last Saturday night, around 8 p.m., IU Health Hospital in Bloomington contacted the Greene County Sheriff’s Department to report a 12-year-old child from Greene County was at their hospital, with the child’s mother, reporting an inappropriate sexual incident had occurred in Greene County by a man who lives in Greene County.

By 9:05 p.m., Det. Cullison had arrived at the hospital and was meeting with the child, the child’s mother, and another adult individual who lives with them. Greene County DCS Caseworker Morgan Young joined Det. Cullison at the hospital and the two of them interviewed the child and the adults together and separately.

What emerged from the interviews was a clear description of an inappropriate sexual incident. The child was able to describe the alleged incident in detail backed up by confirming details of an adult witness who walked into a room during the incident, and the other adult who was also in the home at the time. Jimmy England was named as the suspect.

The child’s family members said they had let England stay in the home because he had a drug problem and they were trying to help. The alleged incident occurred at a time when the adults were asleep.

After conducting the initial interviews, Det. Cullison interviewed England the next day, on Sunday, October 27. According to Det. Cullison, England did confirm that an incident had occurred, but his version differed from the others and he basically blamed the alleged victim.

In an affidavit prepared by Det. Cullison, he details the interviews and circumstances surrounding the allegation, but those details will not appear in this story.

Det. Cullison obtained a DNA sample from England – results pending, and immediately placed England under arrest after the interview.

England was booked in to the Greene County Jail around 2 p.m. last Sunday. His bond is set at $40,000 surety with ten percent cash allowed. It would take $4,000 cash for him to bond out.

Under Indiana law, there are six levels of felonies from Level 1 to Level 6 with Level 1 being the most serious and that’s what England is facing.

England is scheduled to appear in Greene Circuit Court tomorrow morning, Wednesday, October 30, when he will be charged with child molesting, a Level 1 felony.

England does have a criminal record with at least one other case, a misdemeanor, pending against him.

When the case was filed today, October 29, the Greene County Prosecutor also notified the court that the State will seek a habitual offender sentence enhancement.
